Cases of Family Disputes Based on Violation of Ethical and Moral Principles Are Inadmissible
A complaint must contain a specific claim and the facts and grounds for the claim in order to be admitted. And a claim on the ground of violation of ethical and moral principles by family members, especially spouses, is not a specific claim that may be admitted. For example, a claim made on the ground that the defendant, who is a family member of the plaintiff, shows no respect to the plaintiff is not an admissible claim.
Article 1043 of the Civil Code states the moral and ethical principles for family members and family relationship. And according to the SPC's Interpretations Pertaining to the Application of "Title Five Marriage and Family" of the Civil Code (I), a lawsuit filed solely on the grounds stipulated in Article 1043 shall not be admitted, or shall be dismissed if it has been admitted. Article 1043 Families shall practice ethical family values, carry forward family virtues, and attach importance to the enhancement of family ethics and morality.
Spouses shall be loyal to, respect, and care for each other, and family members shall respect the elderly, care for the children, and help each other to maintain equal, harmonious, ethical, and moral marriage and family relations.
